Our son-in-law is about to exchange on a house that has just been built in Havant with a mortgage from Virgin Money. His solicitor has said that there is a delay in receiving the ‘Disclosure of Incentive Form’. This document is news to me - what is it and who needs sight of it?
The document is intended to provide information to the main parties engaged in the transaction. Therefore, it will be provided to your son’s lawyer who should be on the Virgin Money conveyancing panel as a standard part of the process, and to the valuer when requested. The developer will be required to start the process by downloading the form and completing it. The form will therefore need to be available for the valuer at the time of his or her site visit. The form should be sent to the Virgin Money conveyancing panel solicitor as early as possible, in order to avoid any last minute delays, and no later than at exchange of contracts.
The formalities of my purchase has taken place for my property in Havant. Conveyancing was satisfactory but I feel I should register my dissatisfaction about the lender. How does one go about formally complaining?
Most lenders have complaints procedures. Your first port of call should be one of the lender’s branches or the Customer Services Department at head office. Ordinarily complaints to a lender are sorted out very quickly. However if you are not satisfied that the matter is not resolved you can write to Financial Ombudsman Service who will take matters further.
I was told four weeks ago that my mortgage has been agreed to by Coventry BS. Is it usual for Coventry BS to only issue the offer once my solicitor in Havant is approved on their conveyancing panel? Coventry BS have asked my solicitor to see a copy of their PI Insurance.
Mortgage companies tend not to not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Coventry BS to deal with your lawyer's application to be on the Coventry BS conveyancing panel. There's no guarantee that your solicitor will be accepted.
Santander have agreed my home loan in principle, my offer on a apartment in Havant has been accepted, what are the next steps?
Your estate agent will want to know who your solicitors are (be sure the solicitors are on the bank’s panel). Call up Santander or your financial adviser and complete any outstanding paperwork. Santander will appoint a valuer who will get in contact with the estate agent or vendor to book an appointment. Once conducted (assuming no problems) it takes about ten days to get a mortgage offer. Santander will issue the offer to you and your conveyancers. The transaction will then take it’s course according the nature and complexity of the conveyancing in Havant.
The deeds to my house are lost. The conveyancers who dealt with the conveyancing in Havant 10 years ago no longer exist. What are my next steps?
Gone are the days when you need to hold title deeds to prove you own the land or property, as the Land Registry have everything they need in a digital format.
Given that I am about to part with £400,000 on a house in Havant I would like to talk to a solicitor regarding thehouse move in advance of instructing the firm. Can this be arranged?
This is something that we encourage - we would be happy to talk to you we do not take any clients on without you liaising with the conveyancer who will be conducting your conveyancing in Havant. There is no ‘factory style conveyancing’ - each client is unique individual, not a file reference. The law firms that we put you in touch with believe that the fees you are calculated and presented to you for residential conveyancing in Havant should be the figure that you are charged.
We expect to complete the disposal of our £150,000 maisonette in Havant in just under a week. The management company has quoted £324 for Landlord’s certificate, insurance certificate and 3 years service charge statements. Is it legal for a freeholder to charge such fees for a leasehold conveyance in Havant?
Havant conveyancing on leasehold apartments ordinarily necessitates administration charges levied by freeholders :
-
Answering pre-exchange enquiries
Where consent is required before sale in Havant
Copies of the building insurance and schedule
Deeds of covenant upon sale
Registering of the assignment of the change of lessee after a sale

Is the freehold owned collectively by the leaseholders? How long is the Lease? Does the lease have onerous restrictions?
I have been informed by numerous friends to expect up to two months for Havant conveyancing to complete. This was a month ago. The paperwork was only sent from the vendors lawyer yesterday so does the clock start running now?
You should treat with suspicion of any conveyancer promising fast completion times. Instead ask the average timeframe to complete Havant conveyancing transactions and if they are willing to aim towards an agreed target date for your house move in Havant
