I plan on purchasing a maisonette in Emsworth. My property lawyer has never been on on the lender approved list. Is it possible for me to appoint my Emsworth conveyancing solicitor even though they are excluded from the mortgage company list of approved lawyers?
One will need to appoint a solicitor to deal with the formalities if you take out a loan to purchase your home. They will conduct all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage paperwork is dealt with. One may appoint a Emsworth conveyancing practitioner of your choice. However, where the conveyancing practitioner selected is not on the mortgage company solicitor panel additional fees will be incurred as separate legal representation will be required by them. Lender panel applications may be submitted, so if your solicitor has not previously applied for membership they should do so.
I have decided to exercise my right to buy my property in Emsworth off the council. I have a mortgage agreed with Skipton. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should have one. Any advice?
It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with Skipton, you will need to appoint a solicitor on the Skipton conveyancing panel.
I am selling my flat. I had a double glazing fitted in February 2007, but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s mortgage company, Skipton are being difficult. The Emsworth solicitor who is on the Skipton conveyancing panel is saying indemnity insurance will be fine but Skipton are insisting on a building regulation certificate. Why do Skipton have a conveyancing panel if they don't accept advice from them?
It is probably the case that Skipton have referred the matter to their valuer. The reason why Skipton may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing was correctly and safely installed. The indemnity insurance merely protects against enforcement action which is very unlikely anyway.
I was told two weeks ago that my mortgage has been agreed to by Aldermore. Is it usual for Aldermore to only issue the offer once my solicitor in Emsworth is approved on their conveyancing panel? Aldermore have asked my solicitor to see a copy of their PI Insurance.
A lender would not issue a mortgage until they have details of a lawyer on their panel. It can take a few weeks for Aldermore to deal with your lawyer's application to be on the Aldermore conveyancing panel. There's no guarantee that your solicitor will be accepted.
A relative recommended that where I am purchasing in Emsworth I should carry out a Neighbourhood, Planning and Local Amenity Search. Can you explain what the purpose of this search is?

Yesterday I discovered that there is a flying freehold issue on a property I have offered on a fortnight ago in what should have been a straight forward, chain free conveyancing. Emsworth is where the house is located. What do you suggest?
Flying freeholds in Emsworth are unusual but are more likely to exist in relation to terraced houses. Even though you don't necessarily need a conveyancing solicitor in Emsworth you would need to get your solicitor to go through the deeds diligently. Your bank may require your conveyancing solicitor to take out an indemnity policy. Some of the more diligent conveyancing solicitors in Emsworth may ascertain that this is not enough and that the deeds be re-written to give you the most up to date legal protection. If so, the next door neighbour also had to sign up to the revised deeds. It is possible that your lender will not accept the situation so the sooner you find out the better. You should also check with your insurance broker as to whether they will insure a flying freehold property.
My father has suggested that I instruct his lawyers for conveyancing in Emsworth. Do I take his recommendation?
No doubt the best way to find a conveyancing practitioner is to have feedback from friends or relatives who have actually experience in using the firm you're considering.
I acquired a property in Emsworth last 21/5/2025 and to date it is still not registered with HMLR. It was part of a development site and my lawyer told me that it can take one year to complete the registration formalities. I have called the Land Registry directly and they say that the initial application was cancelled due to failure to reply to requisitions. What can I do?
get in touch with your property lawyer - if you are not getting sensible responses, enquire as to their internal complaints process and escalate your problem to a Complaints Manager. Registrations for Emsworth conveyancing are not known to be significantly delayed.
