The vendors of the home we are looking to purchase are using a conveyancing practitioner in Deddington who has recommended a preliminary contract with a non-refundable deposit of 5k. Is it wise to enter into such agreements?
This kind of contract is not the norm in Deddington, conveyancers will often try and steer clients away from them as they detract from the main conveyancing focus and if you end up having your deposit forfeited then the lawyer is left exposed. Secondly, there is no certainty that just because the proprietor has entered into an exclusivity agreement they will complete the sale with you. They may be in contravention of the contract if they receive a big enough financial inducement to do so because an aggrieved buyer with the benefit of a exclusivity agreement will still have to establish consequential losses from the breach and these may not equalise the extra amount that your vendor may gain by breaking the agreement, no matter how morally reprehensible that may be.
Completed the sale of my flat in Deddington last January yet the purchaser is calling every few hours to moan that her solicitor needs to hear from mine. What are the post completion sale legalities following completion?
Following your sale your solicitor should forward the transfer documentation and all supplemental paperwork to the buyer’s solicitors. Depending on the transaction, your solicitor should also confirm that the home loan has been paid off to the buyers solicitors. There are no post completion formalities unique to conveyancing in Deddington.
Can you point me to a directory of Lloyds panel conveyancers in Deddington on the Council of Mortgage Lender’s Website?
Unfortunately not yet. There is no such facility on the CML or Building Society Association sites. Very few lenders make their panel listings open the public over the internet. If you are seeking to appoint a Deddington solicitor on the Lloyds please make the most of our facility.
The formalities of my purchase has taken place for my property in Deddington. Conveyancing was a necessary evil but I would like to complain about the lender. How do I make a complaint?
Most lenders have complaints procedures. Your first port of call should be one of the lender’s branches or the Customer Services Department at head office. We understand that complaints to a lender are sorted out effectively and efficiently. However if you are not satisfied that the matter is not resolved you can write to Financial Ombudsman Service who will take matters further.
After shopping around on the internet I have found a Deddington property lawyer having checked that they are on the Yorkshire BS conveyancing panel. Does my lawyer arrange the survey of the property?
Yorkshire BS will need an independent valuation of the property. Your lawyer will not arrange this. Usually Yorkshire BS will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own Deddington surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller.
I'm purchasing a new build house in Deddington with a mortgage from Platform Home Loans Ltd. The sellers refused to move on the amount so I negotiated 6k of additionals instead. The house builders rep suggested that I not disclose to my solicitor about this extras as it would jeopardize my loan with the lender. Do I keep my lawyer in the dark?.
All lenders require a Disclosure of Incentives Form from the developer of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.
Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.
Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.
As co-executor for the estate of my uncle I am disposing of a residence in Swansea but reside in Deddington. My solicitor (who is 200 miles awayneeds me to sign a stat dec ahead of the transaction finalising. Can you recommend a conveyancing solicitor in Deddington to attest this legal document for me?
strictly speaking you are not likely to need to have the documents witnessed by a conveyancing solicitor. Ordinarily or notary public or solicitor will suffice regardless of whether they are based in Deddington
My nephew is just in the process of moving house, the home loan was agreed last week in principle. After the seller agreed the offer on the house we called the building society to issue the formal offer. I was shocked to learn that mortgage companies do not accept all conveyancer, they have to be on a list, is this legal?
Lenders ordinarily imposes restrictions either the type or the number of conveyancing firms on their approved list of lawyers. A common example of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. You should note that lenders have no responsibility for the quality of advice provided by any Deddington property lawyer on their panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. Statistics from the Land Registry reveal that thousands of law firms only carry out one or two conveyances a year. Those supporting conveyancing panel cuts ask why law firms should have the right to be on a Lender panel when clearly, conveyancing is not their speciality. To put it another way; would you want a conveyancing solicitor to represent you if you were charged with a crime? Unlikely.
