I am not in a position to travel far from Banbury. What is the rationale as to why all Banbury property lawyers are not on all lender panels?
Mortgage Companies tend to impose restrictions on either the type or the number of conveyancing practices on their approved list of lawyers. A common example of such criteria being that a practice needs to have at least two partners. In addition to restricting the structure of firm, some have made a decision to limit the size of their panel they allow to represent them. You should note that lenders have no responsibility for the quality of advice given by any Banbury solicitor on their panel. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago notwithstanding that there are differing opinions concerning whether solicitors sat at the center of that fraud. Statistics from HMLR indicates that thousands of law firms only conduct one or two conveyances annually. Those advocating conveyancing panel pruning ask why law firms should have claim to remain on a lender panel when it is apparent that property law is not their primary expertise?
All was ready to complete my purchase in Banbury next Thursday. My property lawyer now wants me to supply her with evidence of content and building insurance for the property as as she informs me that she is duty bound to validate that it is in order for the mortgage company. What does the insurance need to cover?
All property lawyers on acting for lenders would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in a lender’s UK Finance Lenders’ Handbook conditions. These requirements are not specific to conveyancing in Banbury.
We are buying a flat in Banbury. I might seem paranoid but how we can trust a solicitor? At some point we have to send money into their account. What protection do we have from them run away with our money?
Be assured that all money in a Solicitors client account is 100% safe, and even if your Solicitor ran off with it, the Law Society would reimburse you fully.
I had a mortgage agreed in principle with Aldermore. Banbury conveyancing solicitors are instructed. How long does it take for Aldermore to forward the offer to the conveyancing practitioner?
There is no definitive answer here. Have Aldermore done the valuation? Have you advised Aldermore as to your lawyers' details and checked that your lawyers are on the Aldermore conveyancing panel? Sometimes it can take as long as six weeks for a mortgage offer to be issued.
I currently have a mortgage with Leeds Building Society for my property in Banbury. Conveyancing has been completed 12 months ago. Should I wish to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform Leeds Building Society?
Your original mortgage agreement with Leeds Building Society will provide that you need their approval in advance of renting your property as this is likely to be a breach of Leeds Building Society’s mortgage conditions. It may be that Leeds Building Society will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Leeds Building Society directly. You need not do this via a Leeds Building Society conveyancing panel solicitor.
Will our solicitor be making enquiries regarding flooding during the conveyancing in Banbury.
Flooding is a growing risk for solicitors specialising in conveyancing in Banbury. Plenty of people will buy a property in Banbury, fully expectant that at some time, it may suffer from flooding. However, aside from the physical destruction, where a property is at risk of flooding, it may be difficult to get a mortgage, suitable insurance cover, or dispose of the property. There are steps that can be taken as part of the conveyancing process to forewarn the buyer.
Solicitors are not best placed to offer advice on flood risk, but there are a number of checks that may be carried out by the purchaser or on a buyer’s behalf which will figure out the risks in Banbury. The standard completed inquiry forms supplied to a buyer’s conveyancer (where the Conveyancing Protocol is adopted) includes a usual inquiry of the seller to determine whether the premises has suffered from flooding. If flooding has previously occurred which is not disclosed by the vendor, then a buyer may bring a legal claim for losses as a result of such an incorrect response. A purchaser’s solicitors will also commission an enviro search. This will higlight if there is any known flood risk. If so, further investigations should be initiated.
