Recently asked questions about conveyancing in Hindhead

I am selling my house in Hindhead and the estate agent has just e-mailed to say that the purchasers are switching property lawyer. The excuse is that the mortgage company will only engage with property lawyers on their conveyancing panel. On what basis would a big named mortgage company only deal with specific solicitors rather the firm that they want to appoint to handle their conveyancing in Hindhead ?

Banks have always had panels of law firms they are content to work with, but in the last few years big names such as Santander, have reviewed and reduced their conveyancing panel– in some cases removing conveyancing firms who have acted for them for many years.

Lenders justify this action to a rise in fraud as the reason for the reduction – criteria have been tightened as a smaller panel is easier to monitor. Banks tend not to reveal how many solicitors have been dropped, claiming the information is commercially sensitive, but the Law Society claims that it is hearing daily from firms that have been removed from panels. Some do not even realise they have been dropped until contacted by a borrower who has instructed them as might be the situation in your buyers' case. The purchasers are not going to have any sway in the decision.

I sincerely hope you can assist me. My Hindhead conveyancer is informing me me that she is duty bound toapply for Hindhead conveyancing searches stemming from the fact thatthe firm are on the HSBCapproved lawyer panel. Do I not have any say here?

You have limited options available to you. Given that you are taking out a loan with a lender your solicitor has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of your bank’s conveyancing panel appointment which obliges them to comply with the Council of Mortgage Lenders’ Handbook specifications . Even if you were a cash buyer you would be ill advised not to carry out Hindhead conveyancing searches.

Is it best to go with a Hindhead conveyancing practitioner in close proximity to the house I am hoping to buy? We have a good friend who can perform the legal formalities but her office is 300miles drive away.

The benefit of a local Hindhead conveyancing firm is that you can visit the firm to execute documents, present your identification documents and apply pressure on them where appropriate. Having local Hindhead know how is a benefit. That being said it's more important to get someone that will pull out all the stops for you. If you know people who used your friend and the majority were content that should surpass using an unknown Hindhead conveyancing solicitor solely due to them being round the corner.

I am employed by a reputable estate agency in Hindhead where we have experienced a number of flat sales put at risk as a result of leases having less than 80 years remaining. I have been given conflicting advice from local Hindhead conveyancing firms. Please can you confirm whether the owner of a flat can commence the lease extension formalities for the purchaser on completion of the sale?

Provided that the seller has been the owner for at least 2 years it is possible, to serve a Section 42 notice to commence the lease extension process and assign the benefit of the notice to the purchaser. This means that the buyer can avoid having to sit tight for 2 years to extend their lease. Both sets of lawyers will agree to form of assignment. The assignment has to be done before, or simultaneously with completion of the disposal of the property.

An alternative approach is to extend the lease informally by agreement with the landlord either before or after the sale. If you are informally negotiating there are no rules and so you cannot insist on the landlord agreeing to grant an extension or transferring the benefit of an agreement to the buyer.

Leasehold Conveyancing in Hindhead - Examples of Questions you should ask Prior to Purchasing

Plenty Hindhead leasehold properties will be liable to pay a service charge for the upkeep of the building levied on behalf of the landlord. If you buy the property you will have to pay this liability, usually in instalments during the year. This can vary from several hundred pounds to thousands of pounds for blocks with lifts and large communal grounds. There will also be a rentcharge for you to pay yearly, this is usually not a large amount, say about £50-£100 but you should to check it because sometimes it can be many hundreds of pounds. The prefered form of lease arrangement is a share of the freehold. In this scenario the tenants enjoy being in charge if their destiny and although a managing agent is frequently retained where the building is larger than a house conversion, the managing agent acts for the leaseholders themselves. The answer will be useful as a) areas could result in problems for the building as the common areas may start to deteriorate where services remain unpaid b) if the leasehold owners have an issue with the managing agents you will want to have complete disclosure

We own a leasehold flat in Hindhead. Conveyancing was finished in five years ago. I have read on a number of advice forums that I should not allow the lease length fall too short. Is this correct?

Hindhead residential long term leases are for a fixed term - usually ninety nine years when they are first granted. However a significant flats in Hindhead were built or converted in the 70’s80’s and so such leases now have fewer than eighty years left to run. That may sound like a long time but Banks, Building Societies and other mortgage lenders generally require leases to have a minimum of seventy five years unexpired to be mortgageable. Accordingly when you come to sell the property you will need a lease extension if you are getting close to seventy five years. To maximise your property value you should be thinking about whether to extend your lease long before you come to sell it. There are also significant benefits to taking action before the lease reaches even 80 years as when the lease falls below eighty years the amount to be paid to extend starts to escalate.
