Recently asked questions about conveyancing in Bolsover

We are about to sign contracts for a freehold house in Bolsover. We have hit a stumbling block. The loan offer with Platform Home Loans Ltd runs out on 26/10/2026 but the vendors are insisting on a completion date of 28/10/2026. Is it possible to extend the mortgage offer?

The person best placed to address this question is your solicitors who will hopefully calculate whether he or she is should be discussing with the lender, seller’s lawyers, estate agents or possibly all three taking into account what has happend in your house move to date.

Is it correct that all Bolsover CQS (Conveyancing Quality Scheme) solicitors are on the Santander conveyancing panel?

Some major lenders now use CQS as the starting point for Panel membership such as HSBC and Santander. CQS membership however gives no guarantee to lender panel acceptance. That being said, the CML have indicated that it is likely to become a pre-requisite for solicitors wishing to remain on their panels.

We had appointed solicitors based in Bolsover on the RBS solicitor panel. They have just invoiced me a further charge for the legal aspects of the RBS mortgage. Is this a supplemental conveyancing fee specified by RBS?

As unfair as it may seem, as long as it’s in their Terms of Engagement or estimate then yes your conveyancing practitioner may levy a fee for this. This fee is not dictated by RBS but by your Bolsover conveyancer. Plenty of firms on the RBS panel will quote ’dealing with mortgage’ fee and others do not.

The formalities of my remortgage has taken place for my property in Bolsover. Conveyancing was a necessary evil but I feel I should register my dissatisfaction about the lender. Who do I contact should I wish to lodge a complaint?

All lenders have complaints procedures. Your first point of contact should be one of the lender’s branches or the Customer Services Team at head office. Ordinarily complaints to a lender are sorted out very quickly. However if you are not satisfied that the matter is not resolved you can write to Financial Ombudsman Service who will take matters further.

Due to the guidance of my in-laws I had a survey completed on a property in Bolsover ahead of instructing lawyers. I have been told that there is a flying freehold element to the house. The surveyor advised that some lenders may refuse to grant a loan on such a property.

It varies from the lender to lender. Bank of Scotland has different instructions from Halifax. If you e-mail us we can investigate further via the relevant bank. If you lender is happy to lend one our lawyers can help as they are accustomed to dealing with flying freeholds in Bolsover. Conveyancing can be more complicated and therefore you should check with your conveyancing solicitor in Bolsover to see if the conveyancing costs will increase in light of this.

How do I use the search tool to get a quote from a conveyancing practitioner in Bolsover on the authorised to act for my lender?

First choose a lender such as Yorkshire Building Society, Barnsley Building Society or Platform Home Loans Ltd then specify your preferred area e.g. Bolsover. Conveyancing organisations in Bolsover and across England and Wales should be identified.

My husband and I are novice buyers - had an offer accepted, yet the agent has warned us that the vendor will only go ahead if we use the agent's preferred lawyers as they are insisting on a ‘quick sale’. Our preferred option is to instruct a high street solicitor used to conveyancing in Bolsover

We suspect that the seller is unaware of this request. Should the owner desire ‘a quick sale', taking such a hostile approach to a motivated purchaser is not the way to achieve this. Avoid the agents and go straight to the sellers and make sure they understand (a)you are keen to buy (b)you are ready to go, with finances in place © you are unencumbered (d) you wish to move quickly (e)but you are going to instruct your own, trusted Bolsover conveyancing solicitors - as opposed tothe ones that will earn the negotiator at the agency a kickback or achieve conveyancing figures set by HQ.

My husband and I are buying a first floor flat in Bolsover. At the time of instructing our conveyancing practitioner, they said that they were on all mainstream lender panels. The mortgage broker called yesterday to advise that they don't seem to be on the RBS approved list. Should that be true, what should we do? Do we simply choose a new solicitor that is on their approved list or should we cover the costs for separate representation, with RBS selecting their own approved lawyer.

When acquiring a property with the benefit of a mortgage it is usual for the buyer’s lawyers to also represent the purchaser's lender. In order to act for a bank or building society a lawyer has to be on that lender's conveyancing panel. An application has to be made by the conveyancing practitioner to the lender to become a member of the lender's panel and there are increasingly strict criteria which the conveyancing practitioner has to meet. Some lenders now insist their panel members to be part of the Law Society’s Conveyancing Quality Scheme. Your conveyancer should contact RBS to find out if they can apply for membership of their conveyancing panel, but if that is not viable they will instruct their own lawyers to represent them. You don't have to instruct a firm on RBS's conveyancing panel as you are at liberty to use your preferred Bolsover lawyers, in which case it will likely add costs, and it may delay matters as you are adding another property lawyer into the mix.
