We are hoping to buy a 2 bedroom apartment in Darnall with a mortgage. We have a Darnall solicitor, however the lender says he's not on their "panel". We have to appoint one of the bank panel firms or retain our Darnall solicitor as well as pay for one of their panel lawyers to represent them. We consider that this is inequitable; is there anything we can do?
Unfortunately,no. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the lender’s conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your Darnall conveyancing solicitor to apply to be on the conveyancing panel.
My Solicitor in Darnall has never been on on the Barclays Direct Solicitor Panel. Is it possible for me to retain my prefered solicitor notwithstanding that they are excluded from the Barclays Direct approved list?
Your options are as follows:
- Complete the purchase with your preferred Darnall lawyers but Barclays Direct will need to retain a solicitor on their list of acceptable firms. This will result in additional overall legal fees as well as result in frustration.
- Get a new lawyer to act in the conveyancing, obviously checking they are Barclays Direct approved.
- Persuade your Barclays Direct solicitor to seek to join the Barclays Direct panel

Given that you are obtaining a mortgage with Virgin Money your lawyer must follow the conveyancing instructions set out in Part 2 of UK Finance Lenders’ Handbook for Virgin Money. The Council of Mortgage Lenders’ Handbook stipulates minimum conditions for solar panel roof-space leases, and solicitors are required to report to Virgin Money where a lease does not comply with these specifications. The specifications relate to the installation of panels on properties countrywide and is not restricted to Darnall.
I am selling my house. I had a double glazing fitted in May 2010, but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s mortgage company, Santander are being difficult. The Darnall solicitor who is on the Santander conveyancing panel is saying indemnity insurance will be fine but Santander are insisting on a building regulation certificate. Why do Santander have a conveyancing panel if they don't accept advice from them?
It is probably the case that Santander have referred the matter to their valuer. The reason why Santander may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing was correctly and safely installed. The indemnity insurance merely protects against enforcement action which is very unlikely anyway.

The Landlord must covenant to assume the management if the Management Company goes into liquidation or otherwise defaults in running the management scheme.
Over the last few months I have been searching for a flat up to £235,500 and found one near me in Darnall I like with open areas and transport links in the vicinity, the downside is that it's only got 49 years on the lease. If you require a home loan the shortness of the lease may be problematic. Reduce the price by the amount the lease extension will cost if not already taken into account. If the existing proprietor has owned the property for a minimum of twenty four months you can ask them to commence the lease extension formalities and pass it to you. An additional ninety years can be extended on to the existing lease with a zero ground rent applied. You should speak to your conveyancing solicitor about this.
I dont have enough spare cash to pay a 10% deposit on my house purchase in Darnall , but I am keen proceed. Do I have options?
One option is to try and agree a lesser deposit. Many vendors will agree to a lesser deposit or even no deposit for a first time buyer or 100% mortgage. Be aware though that if you fail to complete you will still need to hand over a minimum of 10% of the purchase price regardless of how much deposit was agreed.
You can also agree a simultaneous exchange and completion as no deposit is required for this however neither party will be tied in until completion actually takes place and it can be risky if sellers change their mind at the last moment
