In what way does my ID and proof of funds have anything to do with my conveyancing in Yorkshire Dales? Why is this being asked of me?
In order to comply with Money Laundering Regulations any Yorkshire Dales conveyancing firm will require evidence of your identity in all conveyancing matters. This is normally dealt with by provision of a passport and an original bank statement or utility account showing your correct address.
Under Money Laundering Regulations, property lawyers are required to investigate not only the identity of conveyancing clients but also the origin of the money that they receive in respect of any matter. Refusal to disclose this may result in your solicitor terminating their relationship with you, as clearly this will cause a conflict between the set Regulations and a refusal to disclose.
Your property lawyers will have an obligation to make a disclosure to the relevant authorities should they believe that any amounts received by them may contravene the Anti-terror and anti-money-laundering rules.
This question may be naive but I am unexperienced as FTB of a garden flat in Yorkshire Dales. Do I receive the keys to the house on the completion date from my lawyer? If this is the case, I will appoint a High Street conveyancing solicitor in Yorkshire Dales?
On the day of completion you do not need to go to the conveyancers office in Yorkshire Dales. Conveyancing lawyers for you will electronically transfer the purchase money to the owner’s conveyancers, and shortly after the monies have arrived, you will be invited to receive the keys from the property Agents and move into your new home. This tends to happen between 1 and 3pm.
We expect to receive a OIP from Virgin Money this week so we can work out what to offer on a property we like as otherwise we are dependent on web based calculators (which aren't taking into account credit checks etc). Do Virgin Money recommend any Yorkshire Dales solicitors on the Virgin Money conveyancing panel, or is it better to go independently?
You will need to appoint Yorkshire Dales solicitors independently although you'll need to choose one on the Virgin Money conveyancing panel. The solicitor represents both you and Virgin Money through the process.
After what seems like an age I have had an offer on a maisonette in Yorkshire Dales accepted, but there is a chain. The vendors have offered on a flat, but it’s not been accepted yet, and are looking at other apartments in the pipeline. I have chosen a high street conveyancing solicitor in Yorkshire Dales. What do I do now? At what point should I apply for the mortgage with Aldermore?
It is usual to have apprehensions where there is a chain as you are unlikely to want to be too out of pocket prematurely (home loan application is in the region of one thousand pounds, then survey, Yorkshire Dales conveyancing search fees, etc). The first course of action is to check that your conveyancer is on the Aldermore conveyancing panel. As to the subsequent phase this very much dictated by the uniqueness of your case, motivation for this property and on the state of the market. During a buoyant market the majority of buyers would apply for the mortgage with Aldermore and pay for the valuation and only if it was satisfactory would they ask their conveyancer to move forward with searches.
I have been told that property searches are a common reason for hinderance in Yorkshire Dales house deals. Is there any truth in this?
The Council of Property Search Organisations (CoPSO) has noted the determinations of a review by MoveWithUs that conveyancing searches do not feature amongst the top 10 causes of hindrances in the conveyancing process. Searches are not likely to feature in any delay in conveyancing in Yorkshire Dales.
It has been 4 months following my purchase conveyancing in Yorkshire Dales concluded. I have checked the Land Registry site which shows that I paid £175,000 when infact I paid £215,000. Why the discrepancy?
The price paid figure is taken from the application to register the purchase. It is the figure included in the Transfer (the legal deed which transfers the premises from one person to the other) and referred to as the 'consideration' or purchase price. You can report an error in the price paid figure using the LR online form. In most cases errors result from typos so at first glance the figure. Do report it so they can double check and advise.
I need to instruct a conveyancing solicitor for remortgage conveyancing in Yorkshire Dales. I have chance upon a site which appears to be the ideal offering If it is possible to get all this stuff completed via email that would be preferable. Do I need to be concerned? What should out be looking out for?
As usual with these online conveyancers you need to read ALL the small print - did you notice the extra charge for dealing with the mortgage?
My wife and I purchased a leasehold house in Yorkshire Dales. Conveyancing and Virgin Money mortgage are in place. I have received a letter from someone claiming to own the freehold. It included a ground rent demand for rent dating back to 1998. The conveyancing practitioner in Yorkshire Dales who previously acted has long since retired. Any advice?
The first thing you should do is make enquiries of the Land Registry to be sure that this person is in fact the registered owner of the freehold reversion. It is not necessary to instruct a Yorkshire Dales conveyancing practitioner to do this as it can be done on-line for less than a fiver. Rest assured that regardless, even if this is the legitimate landlord, under the Limitation Act 1980 the limitation period for recovery of ground rent is six years.
I own a 1 bedroom flat in Yorkshire Dales, conveyancing was carried out 7 years ago. How much will my lease extension cost? Comparable flats in Yorkshire Dales with a long lease are worth £211,000. The ground rent is £45 charged once a year. The lease finishes on 21st October 2093
With only 67 years remaining on your lease we estimate the price of your lease extension to span between £10,500 and £12,000 as well as plus your own and the landlord's "reasonable" professional fees.
The figure that we have given is a general guide to costs for extending a lease, but we cannot give you a more accurate figure without more detailed investigations. You should not use the figures in a Notice of Claim or as an informal offer. There are no doubt additional issues that need to be taken into account and you obviously should be as accurate as possible in your negotiations. Please do not move forward placing reliance on this information without first getting professional advice.
