Can you clarify what the consequences are if my lawyer’s firm is suspended from the Aldermore Conveyancing panel ahead of completing my conveyancing in Wroughton?
The first thing to point out is that, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have to instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by a regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
Do I select a Licenced Conveyancer or Solicitor for conveyancing in Wroughton?
There are two types of lawyers who can conduct conveyancing in Wroughton namely CLC regulated conveyancers or solicitors. The two can handle the legal services that you need to complete the disposal or purchase of property. Both are obliged to handle Wroughton conveyancing on similar standards and guidelines so you can be safe in the knowledge that your conveyancing will be properly carried out and that the requisite steps should be suitably taken.
We expect to receive a DIP from Coventry BS this week so we can work out what to offer on a property we like as otherwise we are dependent on web based calculators (which aren't taking into account credit checks etc). Do Coventry BS recommend any Wroughton solicitors on the Coventry BS conveyancing panel, or is it better to find our own lawyer?
You will need to appoint Wroughton solicitors independently although you'll need to choose one on the Coventry BS conveyancing panel. The solicitor represents both you and Coventry BS through the process.
I have today made my last payment due on my mortgage with Nationwide. I assume I don't need a Wroughton conveyancing practitioner on the Nationwide panel to discharge the mortgage at the Land Registry. Please confirm.
If you have finished paying off your Nationwide mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Nationwide mortgage from the register. Nationwide, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
- but are not moving to another property
- where Nationwide has sent the Land Registry the discharge electronically, and
- Nationwide has instructed the Land Registry to do so

Will control of the Management Company (if any) be handed over to purchasers on completion of the last sale or earlier? Where there is an Undertaking being granted there is the risk of forfeiture of the Headlease subject to relief if one or more of the Underlessees are willing to accept the original Head Lessee’s obligations as otherwise relief will be denied to the Underlessees. The only alternatives are the Head Lessor agreeing not to forfeit the Headlease or the Head Lessee guaranteeing to the Underlessees that it will not be in breach of the Headlease. Will the freehold then be transferred for a nominal consideration (not exceeding £100) to the Management Company? The Vendor must covenant to keep unoccupied units in good repair until long leases are granted therefore.
I am looking for a conveyancing practitioner in Wroughton for my house move. Is there any facility to review a firm’s record with the profession’s regulator?

Can you provide any top tips for leasehold conveyancing in Wroughton with the purpose of saving time on the sale process?
- A significant proportion of the delay in leasehold conveyancing in Wroughton can be avoided where you appoint lawyers as soon as you market your property and ask them to put together the leasehold information which will be required by the buyers’ solicitors. If you have carried out any alterations to the premises would they have required Landlord’s consent? In particular have you installed wooden flooring? Most leases in Wroughton state that internal structural alterations or laying down wooden flooring calls for a licence from the Landlord approving such changes. Where you fail to have the paperwork to hand you should not communicate with the landlord without checking with your conveyancer first. If you have had any disputes with your freeholder or managing agents it is very important that these are resolved before the property is marketed. The purchasers and their solicitors will be reluctant to purchase a property where there is an ongoing dispute. You may have to bite the bullet and pay any arrears of service charge or settle the dispute prior to the buyers completing the purchase. It is therefore preferable to have any dispute settled ahead of the contract papers being issued to the buyers’ solicitors. You are still duty bound to disclose details of the dispute to the buyers, but it is better to reveal the dispute as over as opposed to unsettled. If you are supposed to have a share in the Management Company, you should make sure that you hold the original share document. Arranging a duplicate share certificate is often a lengthy process and slows down many a Wroughton home move. If a duplicate share is needed, you should approach the company officers or managing agents (where applicable) for this at the earliest opportunity.
