I own a freehold property in Wareham yet charged rent, why is this and what is this?

It is rare for properties in Wareham and has limited impact for conveyancing in Wareham but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.

Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges have existed for hundreds of years, but the Rent Charge Act 1977 barred the generation of new rentcharges from 1977 onwards.

Previous rentcharges can now be redeemed by making a one off payment under the Act. Any rentcharges that are still in existence after 2037 is to be dispensed with completely.

I am considering mortgaging my home in Wareham, does my lawyer need to be on the Nationwide Solicitor panel?

There is nothing to stop you using your solicitor, but Nationwide will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.

I have paid off my mortgage with Barclays. I assume I don't need a Wareham conveyancing practitioner on the Barclays panel to remove the mortgage at the Land Registry. Please confirm.

If you have finished paying off your Barclays mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Barclays mortgage from the register. Barclays, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

  1. but are not moving to another property
  2. where Barclays has sent the Land Registry the discharge electronically, and
  3. Barclays has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Barclays mortgage has been paid off.

I have decided to exercise my right to buy my property in Wareham off the council. I have a mortgage offer with Kent Reliance. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should have one. Any advice?

It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with Kent Reliance, you will need to appoint a solicitor on the Kent Reliance conveyancing panel.

The formalities of my purchase has taken place for my property in Wareham. Conveyancing was a necessary evil but I feel I should register my dissatisfaction about the lender. How does one go about formally complaining?

Almost all lenders have complaints procedures. Your first port of call should be one of the lender’s branches or the Customer Care Department at head office. In most cases complaints to a lender are resolved very quickly. However if you are not satisfied that the matter is not resolved you can write to Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR who will take matters further.

What will a local search tell me about the property I am purchasing in Wareham?

Wareham conveyancing often commences with the applying for local authority searches directly from your local Authority or through a personal search company such as Xpress Legal The local search is essential in every Wareham conveyancing purchase; that is if you wish to avoid any unpleasant once you have moved into your property. The search should provide data on, amongst other things, details on planning applications relevant to the premises (whether granted or refused), building control history, any enforcement action, restrictions on permitted development, nearby road schemes, contaminated land and radon gas; in all a total of 13 topic headings.

Due to the input of my in-laws I had a survey completed on a property in Wareham ahead of retaining solicitors. I have been advised that there is a flying freehold overhang to the property. Our surveyor has said that some mortgage companies may not issue a mortgage on this type of property.

It varies from the lender to lender. Lloyds has different instructions from Nationwide. If you call us we can look into this further via the relevant mortgage company. If you lender is happy to lend one our lawyers can help as they are accustomed to dealing with flying freeholds in Wareham. Conveyancing may be slightly more expensive based on your lender's requirements.

Given that I am about to part with £400,000 on a terraced house in Wareham I wish to have a conversation with the conveyancer regarding thetransaction ahead of instructing the firm. Is this something that you can arrange?

Absolutely - we would be happy to talk to you we do not take any clients on without you speaking to the solicitor due to be carrying out your conveyancing in Wareham. There is no ‘factory style conveyancing’ - each client is an important person, not a matter reference.
