Recently asked questions about conveyancing in Skipton

IfI was to buy a freehold housein Skipton for cash and dispense with a survey and no local authority searches how much should I expect to have to pay for conveyancing in Skipton?

Any savings you would make would be isolated to the Skipton conveyancing searches. A conveyancer is obliged to do the vast majority of work - money laundering, liaising with your vendors property lawyer, SDLT submission, register the title etc. A slight saving might be made by not needing to register a mortgage however it will not be significant.

I own a freehold house in Skipton yet pay rent, why is this and what is this?

It is rare for properties in Skipton and has limited impact for conveyancing in Skipton but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.

Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges have existed for hundreds of years, but the Rent Charge Act 1977 barred the generation of fresh rentcharges post 1977.

Old rentcharges can now be redeemed by making a lump sum payment under the Act. Any rentcharges that are still in existence post 2037 is to be extinguished.

We are getting a further advance on our mortgage from Bank of Ireland as we intend to conduct a loft conversion to our home in Skipton. Are we obliged to choose a nearby Skipton solicitor on the Bank of Ireland conveyancing panel to deal with the paperwork?

Bank of Ireland would not normally instruct a member of their approved list of lawyers to handle the formalities. If they do require any legal work then you would need to ensure that such a lawyer was on the Bank of Ireland conveyancing panel.

I have today made my last payment due on my mortgage with Lloyds. I assume I don't need a Skipton property lawyer on the Lloyds panel to discharge the mortgage at the Land Registry. Please confirm.

If you have finished paying off your Lloyds mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Lloyds mortgage from the register. Lloyds, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

  1. but are not moving to another property
  2. where Lloyds has sent the Land Registry the discharge electronically, and
  3. Lloyds has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Lloyds mortgage has been paid off.

I am currently in the process of buying my council flat in Skipton. I have a mortgage agreed with HSBC. Conveyancing is not something I have any knowledge of. Can I proceed without a solicitor easily? I think we can but we keep being told I should use one. Any advice?

It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with HSBC, you will need to appoint a solicitor on the HSBC conveyancing panel.
