Recently asked questions about conveyancing in Scarborough

We are buying a 1 bedroom apartment in Scarborough with a mortgage. We like our Scarborough lawyer, but the bank says she’s not on their "panel". It appears that we have little choice but to use one of the bank panel conveyancing practices or retain our Scarborough conveyancing practitioner as well as pay for one of their panel ones to represent them. This feels very unfair; is there anything we can do?

Unfortunately,no. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the lender’s conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your Scarborough conveyancing solicitor to apply to be on the conveyancing panel.

I have been told that property searches are the number one reason for obstruction in Scarborough conveyancing transactions. Is this right?

The Council of Property Search Organisations (CoPSO) published determinations of research by MoveWithUs that conveyancing searches do not feature amongst the top 10 causes of hindrances during the legal transfer of property. Searches are unlikely to feature in any holding up conveyancing in Scarborough.

The deeds to our property are lost. The solicitors who did the conveyancing in Scarborough 4 years ago have long since closed. What do I do?

Assuming the title is registered the information relating to your proprietorship will be recorded by HMLR with a Title Number. It is easy to execute a search at the Land Registry, locate your property and order current copies of the Registered Entries for a small fee. Where the property is Leasehold then the Land Registry will also normally hold a file duplicate of the Registered Lease and again, a copy can be ordered for £20 inclusive of VAT.

My business partner and I are hoping to take over a lease of an office on a shopping parade. Can you recommend lawyers offering competitive charges for non-domestic conveyancing in Scarborough for under £2000?

We are happy to recommend firms who have an in-depth of experience of commercial conveyancing in Scarborough, including the sale and purchase of businesses as well as simply property. Whether you are hoping to acquire or dispose of a shop, pub, restaurant, office, retail unit or a whole business we can find you the right lawyer. Regarding the costs this will depend on the structure and heads of terms of the proposed transaction. Let us have your details or telephone us so that we may provide you with a fixed commercial conveyancing calculation.

My wife and I purchased a leasehold house in Scarborough. Conveyancing and Chelsea Building Society mortgage organised. I have received a letter from someone claiming to own the freehold. Attached was a demand for arrears of ground rent dating back to 1992. The conveyancing practitioner in Scarborough who previously acted has long since retired. Any advice?

First contact the Land Registry to make sure that the individual claiming to own the freehold is in fact the registered owner of the freehold reversion. There is no need to instruct a Scarborough conveyancing lawyer to do this as you can do this on the Land Registry website for a few pound. Rest assured that regardless, even if this is the rightful freeholder, under the Limitation Act 1980 no more than 6 years of rent can be collected.

Scarborough Conveyancing for Leasehold Flats - A selection of Questions you should consider before buying

Who is in charge of the block? Does the lease have onerous restrictions? Is anyone aware of any major works on the horizon that will likely increase the service costs?

My solicitors in Scarborough have advised me that no longer have my conveyancing file. To assist with my purchase I took out a mortgage with the bank. Is it case that being on the bank conveyancing panel they need to have retained the file for a number of years?

It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the mortgage company Conveyancing Panel Terms. It might be worth you contacting the mortgage company directly.
