Due to complete my purchase in Pratt's Bottom next Monday. I have now been asked to send a copy of my building insurance schedule by my solicitor as as she informs me that she is duty bound to validate that it is in order for the bank. What risks does the mortgage company expect the insurance to cover?
Any lawyer on acting for lenders would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in a lender’s UK Finance Lenders’ Handbook requirements. These requirements are not limited to conveyancing in Pratt's Bottom.
I own a freehold residence in Pratt's Bottom yet charged rent, why is this and what is this?
It’s unusual for properties in Pratt's Bottom and has limited impact for conveyancing in Pratt's Bottom but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.
Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges have existed for hundreds of years, but the Rent Charge Act 1977 barred the creation of fresh rentcharges from 1977 onwards.
Old rentcharges can now be extinguished by making a one off payment under the Act. Any rentcharges that are still in existence post 2037 is to be dispensed with completely.
We had appointed solicitors located in Pratt's Bottom on the Barclays solicitor panel. They have just billed me a separate amount for dealing with the Barclays mortgage. Is this a supplemental conveyancing fee set by Barclays?
As unfair as it may seem, as long as it’s in their Terms and Conditions or Quote then yes your property lawyer is entitled to charge a fee for this. The charge is not dictated by Barclays but by your Pratt's Bottom conveyancing practitioner. Some firms on the Barclays panel will levy an ‘acting for lender’ fee and others do not.
My partner and I have organised a further advance on our home loan from UBS as we want to carry out alterations to our home in Pratt's Bottom. Do we need to select a bricks and mortar Pratt's Bottom solicitor on the UBS conveyancing panel to handle the legals?
UBS don't usually appoint a member of their approved list of lawyers to handle such a matter. If they do require any legal work then you would need to ensure that such a lawyer was on the UBS panel.
I am selling my apartment. I had a double glazing fitted in January 2007, but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s lender, Nottingham are being a right pain. The Pratt's Bottom solicitor who is on the Nottingham conveyancing panel is recommending indemnity insurance as a solution but Nottingham are requiring a building regulation certificate. Why do Nottingham have a conveyancing panel if they don't accept advice from them?
It is probably the case that Nottingham have referred the matter to their valuer. The reason why Nottingham may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing was correctly and safely installed. The indemnity insurance merely protects against enforcement action which is very unlikely anyway.

Am I right to be suspicious by estate agents that I am dealing with are suggesting a nationwide conveyancing firm rather than a local Pratt's Bottom conveyancing firm?
As with lots of service providers, often input from relatives can be worth their weight in gold. Nevertheless there are lots of players in a conveyancing deal; estate agents, mortgage brokers and mortgage companies might all suggest solicitors to choose. Sometimes these conveyancers might be known to one of the organisations as experts in their field, but occasionally there behind the scenes financial incentive behind the recommendation. You have the discretion to choose your own conveyancer. However, bear in mind that some mortgage providers specify a panel list of lawyers you have to use for the mortgage aspect of your conveyancing.
