My wife and I are looking to purchase a property in Newport Pagnell and are in fact using a Newport Pagnell conveyancing firm. Within the past 48 hours our solicitor has sent a preliminary report and documents to look through with the expectation that exchange is imminent. Skipton Building Society have this evening contacted us to inform me that they have now hit a problem as our Newport Pagnell conveyancer is not on their conveyancing panel. What do we do from here?
If you are buying a property with the assistance of a mortgage it is normal for the purchasers' solicitors to also represent the mortgage company. In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Accreditation Scheme. Your property lawyer should contact your mortgage company and see if they can apply for membership of their conveyancing panel, but if that is not viable they will instruct their own solicitors to act. You don't have to instruct a firm on the bank's conveyancing panel as you are at liberty to use your preferred Newport Pagnell lawyers, in which case your legal fees may increase, and it will likely delay the transaction as you have another set of people involved.
We are acquiring a newly constructed flat in Newport Pagnell and my solicitor is informing me that she is duty bound to the mortgage company to disclose incentives from the developer. I am on a tight deadline to exchange contracts and my preference is not to delay deal. is my lawyer playing by the book?
You should not exchange unless you have been advised to do so by your solicitor. A precondition to being on a mortgage company panel is to comply with the UK Finance Lenders’ Handbook provisions. The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.
I am purchasing a right to buy a flat in Newport Pagnell. Conveyancing solicitors are said to be ‘a necessary evil’ but can I do it myself?
Leaving aside the complexities and merits of DIY conveyancing in Newport Pagnell you will have to appoint a solicitor on your lender's conveyancing panel to look after their interests. Most people therefore find it easier to let the solicitor act for them and the lender. Furthermore there is minimal cost savings to be made in you doing conveyancing for yourself and another lawyer conducting the conveyancing for the lender. Please feel free to use the search tool to find a lawyer on your lender panel in Newport Pagnell.
I happen to be the only beneficiary of my late father’s estate with all property in now in my sole name, including the my former home in Newport Pagnell. The Newport Pagnell property was put into my name in July. I want to move. I do know about the CML 6 month 'rule', which means that my proprietorship will be treated the same way as if I'd bought the house in July. Will no one buy the property for half a year?
The Council of Mortgage Lenders’ handbook instructs conveyancers to: "report to us immediately if the owner or registered proprietor has been registered for less than six months." By the strict wording you might be affected by that. How sensible a view lenders take of it, depend on the lender as this obligation is principally there to capture the purchase and immediately sell or the wholesaling and assigning of properties.
I currently have a mortgage with Coventry BS for my property in Newport Pagnell. Conveyancing was finalised some time ago. Should I wish to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a BTL mortgage or inform Coventry BS?
Your original mortgage agreement with Coventry BS will provide that you need their approval in advance of renting your property as this is likely to be a breach of Coventry BS’s mortgage conditions. It may be that Coventry BS will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Coventry BS directly. You need not do this via a Coventry BS conveyancing panel firm.
I've read lots of house buying guides, I note that it is considered advisable to get your house surveyed prior to buying it. When I asked my local Newport Pagnell solicitor - who is on the Yorkshire BS conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. Is that normal?
Yorkshire BS will need an independent valuation of the property. Your lawyer will not arrange this. Usually Yorkshire BS will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. Your conveyancer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by your Newport Pagnell postcode. As you are getting a mortgage with Yorkshire BS, you could contact them to see if they have a list of approved surveyors in Newport Pagnell.
I opted to have a survey done on a property in Newport Pagnell ahead of retaining conveyancers. I have been advised that there is a flying freehold element to the property. Our surveyor has said that some banks will not grant a loan on such a house.
It depends who your proposed lender is. HSBC has different requirements from Nationwide. If you contact us we can check with the appropriate mortgage company. If you lender is happy to lend one our lawyers can assist as they are accustomed to dealing with flying freeholds in Newport Pagnell. Conveyancing may be slightly more expensive based on your lender's requirements.
I'm remortgaging my current house to a buy to let loan with Virgin Money and intend to use the remaining equity as a deposit on further property. The location we are talking about is Newport Pagnell. Will your conveyancers be able to act for the two mortgage companies and tie in the conveyances?
Do use our search tool on this page to be sure that the solicitors are approved by both mortgage companies. Assuming that they are your lawyer will be able to connect the two conveyancing matters but you should talk with you conveyancer and specify your expectations and needs.
