Me and my wife are acquiring our first property. Our conveyancing practitioner has contact usto ask if we would like to take out extra conveyancing searches. We are really unsure what's recommended for conveyancing in Moulton
The type of Moulton conveyancing searches should be triggered based primarily on the premises, the location, the possibility of any of these risks, your familiarity of the region and risks, your overall appetite to risk. What is important is that you adequately understand what information each search could provide. Then you can decide if you consider that you need that search. If unsure, ask your lawyer to guide you.
We have agreed to purchase a house in Moulton. One unusual aspect is that the roof has a solar panel. UBS have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?
As your lender is UBS your lawyer must follow the formal instructions contained in Section two of UK Finance Lenders’ Handbook for UBS. The CML Handbook contains minimum conditions for solar panel roof-space leases, and property lawyers are required to report to UBS where a lease does not satisfy these conditions. The specifications relate to the installation of panels on properties nationwide and is not isolated to Moulton.
I have decided to exercise my right to buy my property in Moulton off the council. I have a mortgage offer with Bank of Ireland. Conveyancing is not something I have any knowledge of. Can I proceed without a solicitor easily? I think we can but we keep being told I should use one. Any advice?
It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with Bank of Ireland, you will need to appoint a solicitor on the Bank of Ireland conveyancing panel.
After shopping around on the internet I have found a Moulton property lawyer having checked that they are on the Santander conveyancing panel. Does my lawyer arrange the survey of the property?
Santander will need an independent valuation of the property. Your lawyer will not arrange this. Usually Santander will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. Your solicitor will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by your Moulton postcode. As you are getting a mortgage with Santander, you could contact them to see if they have a list of approved surveyors in Moulton.
I am buying a new build house in Moulton with the aid of help to buy. The builders refused to budge the amount so I negotiated 6k of extras instead. The sale representative advised me not to tell my conveyancer about the deal as it would adversely affect my mortgage with the lender. Is this normal?.
All lenders require a Disclosure of Incentives Form from the developer of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.
Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.
Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.
I've recently found out that there is a flying freehold issue on a house I put an offer in two weeks back in what was supposed to be a simple, no chain conveyancing. Moulton is where the house is located. Can you shed any light on this issue?
Flying freeholds in Moulton are unusual but are more likely to exist in relation to terraced houses. Even where you use a solicitor outside Moulton you would need to get your solicitor to go through the deeds very carefully. Your mortgage company may require your conveyancing solicitor to take out an indemnity policy. Some of the more diligent conveyancing solicitors in Moulton may determine that this is not enough and that the deeds be re-written to give you the most up to date legal protection. If so, the next door neighbour also had to sign up to the revised deeds. It is possible that your lender will not accept the situation so the sooner you find out the better. You should also check with your insurance broker as to whether they will insure a flying freehold property.
