Recently asked questions about conveyancing in Macclesfield

I have been recommended a conveyancing solicitor in Macclesfield. I I would like to check whether they are on the Alliance & Leicester conveyancing panel. Could you assist?

The first thing to do is phone your solicitor and ask them whether they can act for the lender. Otherwise you should get in touch with Alliance & Leicester who may be able to help.

My partner and I are close to exchanging contracts on the sale of our property in Macclesfield and the buyers lawyers are claiming that there is a risk of it being built on contaminated land. A high street Macclesfield lawyer would know that there is no such problem. For the life of me I don't know why the purchasers instructed a nationwide conveyancing outfit rather than a conveyancing solicitor in Macclesfield. We have lived in Macclesfield for 4 years we know of no issue. Should we get in touch with our local Authority to obtain confirmation need.

It would appear that you have a conveyancing lawyer currently acting for you. What do they say? You need to enquire of your lawyer before you do anything. It is very possible that once the local authority has been informed of a potential issue it cannot be insured against (a bit like being diagnosed with a serious illness and then taking out health insurance to cover that same ailment)

four months have gone by following my purchase conveyancing in Macclesfield took place. I have checked the Land Registry website which shows that I paid £150,000 when infact I paid £160,000. Why the discrepancy?

The price paid figure is taken from the application to register the purchase. It is the figure included in the Transfer (the legal deed which transfers the residence from one person to the other) and referred to as the 'consideration' or purchase price. You can report an error in the price paid figure using the LR online form. In most cases errors result from typos so at first glance the figure. Do report it so they can double check and advise.

I am purchasing a new build house in Macclesfield with a mortgage from Lloyds TSB Bank. The sellers refused to move on the amount so I negotiated five thousand pounds worth of fixtures and fittings instead. The house builders rep suggested that I not disclose to my solicitor about this extras as it may impact my mortgage with the lender. Do I keep my lawyer in the dark?.

All lenders require a Disclosure of Incentives Form from the developer of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.

Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.

Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.

Are there any apps to help identify a Macclesfield law firm on the Bank of Ireland conveyancing panel? I drive a motor bike and am willing to travel upto 20miles to meet the lawyer.

Feel free to make use of the search on this website. Please pick a lender and your location and you will see a number of Macclesfield conveyancing lawyers locally. We have detailed some Macclesfield conveyancing firms at the bottom of this page and you can telephone them to check if they are on the Bank of Ireland member panel

I am an executor of my recently deceased aunt’s Will, with a property in Macclesfield which is to be sold. The bungalow is unregistered at HMLR and I'm told that many buyers solicitors will insist that it is in place before they will move forward. What's the mechanism for this?

In the circumstances you refer to it seems prudent to seek to register in the names of the personal representative(s) as named in the probate and in their capacity as PRs. The Land Registry’s online guidance explains how to register for the first time and what is required re the deeds and forms. You would need to include and certified copy of the probate as well and complete the form FR1 to refer to the PRs as the applicant.
