My IFA requires my Leominster lawyer’ panel member for the HSBC conveyancing panel. How do I discover this. I have tried my local Leominster branch but they have not got back to me yet.
You are best placed to get this information from your Leominster solicitor . They retain a central record lender panel numbers.
My partner and I are refinancing our maisonette in Leominster with Skipton. We have a son approaching twenty who lives at home. Our solicitor requested us to identify anyone over the age of 17 other than ourselves who reside at the property. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the property is repossessed. I have a couple of questions (1) Is this document specific to the Skipton conveyancing panel as he did not need to sign this form when we remortgaged 4 years ago (2) Does our son by signing this extinguish his entitlement to inherit the property?
On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Skipton. This is solely used to protect Skipton if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Skipton had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
It is 10 years ago since I purchased my home in Leominster. Conveyancing lawyers have now been retained on the sale but I am unable to locate the deeds. Will this cause complications?
Don’t worry too much. Firstly the deeds may be with the lender or they could be in the possession of the solicitor who handled your purchase. Secondly in all probability the land will be registered at the land registry and you will be able to prove you own the property by your conveyancing lawyers acquiring up to date copy of the land registers. Almost all conveyancing in Leominster relates to registered property but in the unlikely event that your property is not registered it adds to the complexity but is resolvable.
I just bought a house at auction in Leominster. Conveyancing is necessary. What is next?
Now that you have legally bound yourself to purchase you will need to retain a conveyancing solicitor soon as you are faced with a fast approaching deadline in which to complete the conveyancing. An auction property will ordinarily have a corresponding legal set of papers. This will include evidence of title and search results. In the case of leasehold premises the legal papers may include a copy of the lease, management information and a sellers leasehold information form and other conveyancing paperwork pertinent to leasehold premises. You should hand this to the solicitor working for you at the earliest opportunity. Do make sure that your finances are organised to complete on the date specified in the contract.
We have agreed to purchase a house in Leominster. One unusual aspect is that the roof has a solar panel. Clydesdale have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?
Given that your lender is Clydesdale your lawyer must check the conveyancing instructions outlined in Part 2 of UK Finance Lenders’ Handbook for Clydesdale. The Council of Mortgage Lenders’ Handbook contains minimum conditions for solar panel roof-space leases, and conveyancing practitioners are required to report to Clydesdale where a lease fails to meet these specifications. The provisions relate to the installation of panels on properties in England and Wales and is not restricted to Leominster.
I have today made my last payment due on my mortgage with Barclays. I assume I don't need a Leominster conveyancer on the Barclays panel to discharge the mortgage at the Land Registry. Am I right?
If you have finished paying off your Barclays mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Barclays mortgage from the register. Barclays, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
- but are not moving to another property
- where Barclays has sent the Land Registry the discharge electronically, and
- Barclays has instructed the Land Registry to do so
Various web forums that I have visited warn that are the main reason for obstruction in Leominster conveyancing transactions. Is this right?
The Council of Property Search Organisations (CoPSO) has noted the findings of research by MoveWithUs that conveyancing searches do not figure amongst the most frequent causes of delays in the conveyancing process. Local searches are unlikely to feature in any slowing down conveyancing in Leominster.
I want to rent out my leasehold apartment in Leominster. Conveyancing solicitor who did the purchase is retired - so can't ask him. Is permission from the freeholder required?
Even though your last Leominster conveyancing solicitor is not around you can review your lease to see if it allows you to sublet the property. The rule is that if the deeds are non-specific, subletting is permitted. There may be a precondition that you must obtain permission from your landlord or other appropriate person prior to subletting. The net result is that you cannot sublet in the absence of prior consent. Such consent is not allowed to be unreasonably withheld. If your lease prohibits you from letting out the property you will need to ask your landlord if they are willing to waive this restriction.
I own a garden flat in Leominster, conveyancing formalities finalised half a dozen years ago. Can you shed any light on how much the price could be for a 90 year extension to my lease? Equivalent flats in Leominster with a long lease are worth £176,000. The ground rent is £50 yearly. The lease terminates on 21st October 2076
With only 50 years left to run the likely cost is going to be between £31,400 and £36,200 plus professional fees.
The figure above a general guide to costs for extending a lease, but we are not able to provide a more accurate figure without more comprehensive due diligence. You should not use the figures in a Notice of Claim or as an informal offer. There are no doubt other concerns that need to be taken into account and you obviously want to be as accurate as possible in your negotiations. Neither should you take any other action placing reliance on this information before getting professional advice.
