Recently asked questions about conveyancing in Bridgwater

Due to complete my purchase in Bridgwater next Tuesday. I have now been asked to send a copy of my building insurance schedule by my solicitor as he says that he has to check this in his capacity as lawyer for the bank. What risks does the mortgage company expect the insurance to cover?

Any lawyer on acting for lenders would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in a lender’s UK Finance Lenders’ Handbook instructions. These obligations are not specific to conveyancing in Bridgwater.

My husband and I are hoping to buy a purpose built flat in Bridgwater with a mortgage from Chelsea Building Society. We have a Bridgwater conveyancing practitioner but Chelsea Building Society advised that she’s not listed on their approved list of firms. We have to appoint a Chelsea Building Society panel lawyer or keep our preferred solicitor and fork out for one of their panel ones to represent them. We feel as though this is unjust; Can we not simply insist that Chelsea Building Society use our lawyer?

Unfortunately,no. The loan issued to you contains various provisions, one of which will be that conveyancers must be on the Chelsea Building Society conveyancing panel. Until recently, most mortgage companies had large numbers of solicitors on their panels: a borrower could find one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your solicitors to apply to be on the conveyancing panel for Chelsea Building Society

When it comes to mortgage companies such as Nationwide, do Bridgwater property lawyers face an annual charge to be on the conveyancing panel?

We are unaware of any mortgage company fees to register on their list of approved firms, although some do levy an administration charge to deal with the processing of the conveyancing panel submission.

Intending to buy a maisonette in Bridgwater. I have received an online quote from a licenced conveyancer, which states: "There will be no charge for dealing with the Lender if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Aldermore conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.

They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that the Bridgwater conveyancer is on the Aldermore conveyancing panel.

I've digested plenty of mortgage guides, I note that it is considered advisable to get your house surveyed prior to buying it. When I asked my local Bridgwater solicitor - who is on the Lloyds conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. is that correct?

Lloyds will need an independent valuation of the property. Your lawyer will not arrange this. Usually Lloyds will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. Your conveyancing practitioner will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by your Bridgwater postcode. As you are getting a mortgage with Lloyds, you could contact them to see if they have a list of approved surveyors in Bridgwater.

A friend suggested that where I am buying in Bridgwater I should carry out a Neighbourhood, Planning and Local Amenity Search. Can you explain what the purpose of this search is?

This is a search is usually included in the estimate for your Bridgwater conveyancing searches. It is not a small document of about 40 pages, listing and detailing significant information about Bridgwater around the property and the people living there. It incorporates an Aerial Photograph, Planning Applications, Land Use, Mobile Phone Masts, Rights of Way, the Bridgwater Housing Market, Council Tax Banding, the demographics of People living in the area, the dominant type of Housing, the Average Property Price, Crime statistics, Bridgwater Education with plans and statistics, Local Amenities and other useful information regarding Bridgwater.

I have recentlydiscovered that Action Conveyancing have been shut down. They carried out my conveyancing in Bridgwater for a purchase of a leasehold apartment 12 months ago. How can I be sure that the property is in my name in the name of the previous owner?

The easiest way to check if the property is in your name, you can carry out a search of the land registry (£3.00). You can either do this yourself or ask a law firm to do this for you. If you are not registered you can seek help from one of a number of Bridgwater conveyancing specialists.

How does conveyancing in Bridgwater differ for new build properties?

Most buyers of new build property in Bridgwater come to us having been asked by the developer to sign contracts and commit to the purchase even before the residence is built. This is because new home sellers in Bridgwater typically acquire the land, plan the estate and want to get the plots sold off as they are building the properties. Buyers, therefore, will have to exchange contracts without actually seeing the house they are buying. To reduce the chances of losing the property, buyers should instruct conveyancing solicitors as soon as the property is reserved and mortgage applications should be submitted quickly. Due to the fact that it could be several months and even years between exchange of contracts and completion, the mortgage offer may need to be extended. It would be wise to use a lawyer who specialises in new build conveyancing especially if they are accustomed to new build conveyancing in Bridgwater or who has acted in the same development.
