Recently asked questions about conveyancing in Settle

It has come to my attention via my mortgage adviser that my Settle the law firm I have appointed is not on the bank Conveyancing panel. How can I check?

The first thing you need to do is to call your Settle conveyancer. You lawyer should notify you of the situation. If they are not on the panel they may be able to suggest a Settle conveyancing firm that is on the conveyancing panel for your mortgage company.

I am downsizing from our property in Settle and according to the buyers it appears that there is a possibility that the property was constructed land that was not decontaminated. Any local conveyancer would know this is not the case. For the life of me I don't know why the purchasers instructed an online conveyancing firm as opposed to a conveyancing solicitor in Settle. We have lived in Settle for three years we know that this is a non issue. Should we contact our local Authority to obtain confirmation that the buyers are looking for.

It sounds as though you may have a conveyancing solicitor already. Are they able to advise? You need to enquire of your lawyer before you do anything. It is very possible that once the local authority has been informed of a potential issue it cannot be insured against (a bit like being diagnosed with a serious illness and then taking out health insurance to cover that same ailment)

4 months have elapsed since my purchase conveyancing in Settle concluded. I have checked the Land Registry website which shows that I paid £175,000 when infact I paid £170,000. Why the discrepancy?

The price paid figure is taken from the application to register the purchase. It is the figure included in the Transfer (the legal deed which transfers the residence from one person to the other) and referred to as the 'consideration' or purchase price. You can report an error in the price paid figure using the LR online form. In most cases errors result from typos so at first glance the figure. Do report it so they can double check and advise.

I'm purchasing a new build house in Settle benefiting from help to buy. The developers would not reduce the amount so I negotiated £7000 of additionals instead. The sale representative told me not to tell my solicitor about the deal as it may put at risk my mortgage with the bank. Is this normal?.

All lenders require a Disclosure of Incentives Form from the builder of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.

Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.

Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.

Due to the input of my in-laws I had a survey completed on a house in Settle before retaining solicitors. I have been advised that there is a flying freehold element to the property. Our surveyor advised that some lenders tend refuse to give a loan on such a premises.

It varies from the lender to lender. Lloyds has different instructions from Halifax. Should you wish to telephone us we can check via the appropriate bank. If you lender is happy to lend one our lawyers can help as they are used to dealing with flying freeholds in Settle. Conveyancing may be slightly more expensive based on your lender's requirements.

We're FTB’s - agreed a price, yet the property agent informed us that the owners will only move forward if we use the agent's preferred conveyancers as they need a ‘quick sale’. We would rather use a local solicitor with experience of conveyancing in Settle

We suspect that the owner is unaware of this request. If they require ‘a quick sale', turning down a serious purchaser is is going to put the whole deal at risk. Avoid the agents and go straight to the owners and make the point that (a)you are keen to buy (b)you are excited to move forward, with mortgage lined up © you do not need to sell (d) you intend to proceed fast (e)however you are going to instruct your preferred Settle conveyancing firm - not the ones that will provide the negotiator at the agency a referral fee or hit his conveyancing thresholds demanded by corporate headquarters.
